NYPL Summer Reading Challenge Terms and Conditions

Welcome to Summer Reading!  Summer Reading (which we sometimes refer to as the "Website") is provided to you by The New York Public Library. We are excited about your visit to Summer Reading, but there are some rules for how Summer Reading works.  By accessing or using this Website, you agree to these Terms and Conditions.

Privacy Policy

By your access and use of the Website (or if you are a parent or guardianby permitting your child to use the Website), you agree to the terms of the Summer Reading Privacy Policy, which are incorporated into these Terms and Conditions by this reference.

Modifications

We reserve the right to change our policies at any time without notice.  Any changes to this Terms and Conditions will be posted here, and we encourage you to check back from time to time to see the most current version of our Terms and Conditions.  We will also keep prior version of this Terms and Conditions in an archive for your review.          

Registration

You may register for Summer Reading at your local participating library or at home via the Website. As part of registration, you will need to select a username and password. If you use the Website, you are responsible for your account and password and making sure you don’t share it with anyone (except your parent or guardian). If someone accesses Summer Reading with your user name and password, we will think it is you and you can be responsible for their conduct.

Use of this Site

The Website may contain features that allow users to input information. By posting, uploading, inputting, providing, sending, or submitting any content to the Website, you agree to the following:

  • You will not use the Website or upload or transmit anything that is against the law or infringes or violates any rights of any party.

  • You will not use the Website to distribute advertising or other unsolicited material to any third party.

  • You will not send us anything that is inappropriate (like stuff that is against the law, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful or embarrassing).

  • You will not impersonate another person or try to login as someone else or open an account for someone else.

  • You will not violate The New York Public Library’s rules and regulations.  

We also have the ability to close your account or prevent you from accessing Summer Reading at any time.  We will cooperate with the police or other law enforcement in connection with any inquiry into any user or any user content and may disclose information pertaining to any user and any user content to any governmental authority as may be requested.

Electronic Communications

You agree that all agreements, terms, notices, disclosures and other communications provided to you electronically satisfy any legal requirement that such communication be in writing.

Intellectual Property Rights

IN NO EVENT SHALL THE PARTICIPATING LIBRARIES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, INFORMATION, PROFITS OR INTERRUPTION) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR PERFORMANCE OF THE WEBSITE, WHETHER SUCH DAMAGES ARE BASED IN TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Cancellation Policy

Accounts can be canceled at any time by contacting your local library running the Summer Reading or sending an email to ask@nypl.org.

You agree to indemnify, defend, and hold harmless The New York Public Library, its officers, representatives, directors, employees, consultants and agents from any and all losses, expenses, third-party claims, liabilities, damages and costs (including without limitation attorneys’ fees) arising from or related to your use of the Website, your use of any material, information or data downloaded or otherwise obtained from this Website, or your violation of these Terms and Conditions, including without limitation, your infringement of any intellectual property or other right of the Participating Libraries or any other person or entity.

Governing Law

These Terms and Conditions are governed by the laws of the United States and the State of New York.  Any cause of action or claim with respect to this website must be commenced within one (1) year after the action or claim arises.

Entire Agreement

These Terms and Conditions, together with the Summer Reading Privacy Policy constitute the entire agreement between you and The New York Public Library with respect to your access and use of the Website and supersede all prior or contemporaneous understandings or agreements, written or oral.
