Summary
A symposium centered on how dance companies should continue (or not) after their founders and guiding lights have died, as well as what should happen to their archival materials. The event seeks to answer this question from the viewpoint of company members, society as a whole, and present and future audiences and scholars. Additionally, it seeks to establish the range of available options for the artworks themselves in terms of public performance, preservation, access, rights, restaging/reworking, etc. after their creators (primarily choreographers, in this instance) are deceased. The panelists include Trevor Carlson (Merce Cunningham Dance Foundation); Janet Eilber (Martha Graham Center of Contemporary Dance); Barbara Horgan (George Balanchine Trust); Martin I. Kagan and John Tomlinson of the Paul Taylor Dance Company; Libby Smigel (Dance Heritage Coalition); Allan G. Sperling and Theodore W. Striggle, Esqs., Lynne Weber (Dance Notation Bureau) and new media consultant Josh Telson. The panel is split into two halves: 75 minutes on planning, process and legal considerations, followed by an hour on documentation and preservation, with a Q&A segment at the end of each. Following agenda-setting remarks by moderator Diane Ragsdale (of the Andrew W. Mellon Foundation), Trevor Carlson gives an overview of the MCDF's Living Legacy Plan. (6:00) This is followed by Barbara Horgan of the George Balanchine Trust discussing both the Trust's inception and its current work. (18:20) The Martha Graham Center of Contemporary Dance's Janet Eilber then discusses the copyright/inheritance lawsuit brought against the MGCCD in the mid-2000s, and its impact on the company and the larger world of dance. (25:50) This shifts into a general consideration of the legal, tax and licensing considerations faced by legacy companies, as well as a consideration of whether these organizations should continue to produce new work, while utilizing archival material in new ways and for new audiences. (30:35) Carlson then discusses the decision to close the MCDC, which segues into a conversation about ways of considering succession issues before the death of a founder occurs. (43:00) Rights issues that companies should consider when confronting these decisions, and varying approaches to copyright and licensing concerns. (50:50) Methods of determining the financial value of a work or group of works (57:20) Determining when to begin discussions on these topics and some guidance for a general timeline. (60:00) A discussion of how to deal with the various iterations and layers of copyright that may be inherent in a given situation. (67:00) Making decisions regarding what should be done with an organization's archives (71:10) The panel ends with a discussion of the Merce Cunningham Digital Dance Capsules online repository and an extended general conversation about dance preservation, documentation, access and rights, with a particular focus on the New York Public Library's Merce Cunningham archive, including comments on the collection from NYPL Performing Arts Executive Director Jacqueline Z.
